Fusion FX — Last updated: [DATE — PENDING LEGAL REVIEW]
Risk Warning: CFDs are complex instruments and come with a high risk of losing money rapidly due to leverage. You should consider whether you understand how CFDs work and whether you can afford to take the high risk of losing your money.
1. About These Terms
These Terms of Service (“Terms”) form the agreement between you and Fusion FX (UK) LTD, registered address 24th floor, One Canada Square, Canary Wharf, London E14 5AB (“Fusion FX”, “we”, “us”, “our”). A Financial Services Company authorised and regulated by the Financial Conduct Authority (FCA) under the license FRN 583263.
They apply to your use of this website, your trading account and our web trading platform (the “Platform”). By opening an account or using the Platform you accept these Terms, our Risk Disclosure and our Privacy Policy. If you do not agree, do not open an account.
[PENDING LEGAL REVIEW] These Terms are a summary client agreement and are subject to review by the business's legal advisers.
2. Our Service
We offer Contracts for Difference (“CFDs”) on forex, cryptocurrencies, stocks, index ETFs and commodities. CFDs are cash-settled: you never own the underlying asset. We act as principal and are the counterparty to every trade you place with us. We do not route your orders to an exchange.
3. Eligibility
To open an account you must:
- be at least 18 years old and have full legal capacity;
- not be resident in, or a citizen of, a country where offering CFDs is restricted or prohibited, including [RESTRICTED JURISDICTIONS];
- open the account in your own name and for your own benefit; and
- provide accurate, complete and current information.
It is your responsibility to make sure that trading CFDs is lawful where you live. We may refuse any application without giving a reason.
4. Account Opening, KYC and Anti-Money-Laundering
We are required to verify your identity and to prevent money laundering and terrorist financing. When you register we will ask for your name, email address, phone number and country, and before you can deposit, trade or withdraw we may ask for identity documents, proof of address, information about the source of your funds and other information we reasonably need. We may use third-party verification providers.
We may also assess whether CFDs are appropriate for you based on your knowledge and experience. If we consider they are not, we will warn you, and we may decline to open an account.
We may delay, suspend or refuse a deposit, withdrawal or trade, or close your account, if we cannot complete these checks or suspect unlawful activity. You must tell us promptly if your details change. You may hold only one account unless we agree otherwise.
5. Execution Only — No Advice
Our service is execution-only. We do not give investment, tax or legal advice and do not recommend any trade. Any market information, charts, news or educational content we provide is general and is not tailored to you. Every trading decision is yours alone.
6. Orders and Execution
You can place market, limit and stop orders on the Platform, and attach stop-loss and take-profit levels to open positions. An order is only accepted when the Platform confirms it.
- Market orders are executed at the next available price, which may differ from the price displayed when you clicked.
- Limit and stop orders are triggered when our quoted price reaches the level you set; stop orders and stop-losses may be filled at a worse price if the market gaps or moves quickly.
- Some instruments (US stocks, index ETFs and commodity ETFs) can only be traded during their US market hours. Orders cannot be executed while an instrument's market is closed.
- We may reject or cancel an order that exceeds your available margin, breaches any limit we set, or is placed during a Platform or market disruption.
You are responsible for all orders placed using your login credentials.
7. Prices and Spreads
All prices on the Platform are set by us, based on third-party market data. They may differ from prices on exchanges or other platforms. During market hours, in quiet periods, quotes may be generated between exchange prints within a band around the last traded price. Commodity CFDs are priced from exchange-traded funds that track the commodity, not from futures. Each price has a buy and a sell side; the difference (the spread) is a cost to you and may vary. Current spreads: [SPREAD SCHEDULE].
8. Margin and Leverage
You must maintain enough margin in your account to support your open positions. Leverage of up to 1:50 is available, and we may set lower leverage for particular instruments or accounts and change margin requirements at any time, including for open positions, in particular around market events.
Your margin, equity and free margin are shown on the Platform in real time. If your margin level falls to [STOP-OUT LEVEL]% or below, we may close some or all of your open positions without notice. We are not obliged to issue a margin call before doing so.
Negative balances: [NEGATIVE BALANCE PROTECTION POLICY].
9. Overnight Charges and Fees
Positions held open past the daily rollover time may be charged or credited an overnight (swap) amount, calculated as shown on the Platform: [SWAP CALCULATION AND RATES]. Other fees that may apply: [COMMISSIONS / CURRENCY CONVERSION FEE / OTHER FEES]. We will give you at least [NOTICE PERIOD] notice before introducing a new fee or increasing an existing one.
10. Deposits and Withdrawals
You may fund your account using the methods shown in your account area: [ACCEPTED PAYMENT METHODS]. Deposits must come from an account or card in your own name. Third-party payments will be returned.
Withdrawals are paid back to the method you deposited from where possible, and only after your identity has been verified. Withdrawal processing time: [PROCESSING TIME]. Minimum amounts and fees: [DEPOSIT / WITHDRAWAL MINIMUMS AND FEES]. You cannot withdraw funds that are being used as margin for open positions.
11. Inactive Accounts
If there is no trading or funding activity on your account for [INACTIVITY PERIOD], an inactivity fee of [INACTIVITY FEE] may be charged, up to the available balance. The fee never makes your balance negative.
12. Manifest Errors and Platform Faults
If a trade is opened or closed at a price that is clearly wrong — for example because of a faulty data feed, a software error or an obvious mispricing (a “manifest error”) — we may cancel the trade or adjust it to the correct market price at the time. We will act fairly and tell you as soon as reasonably possible. The same applies to trades affected by a Platform malfunction.
13. Prohibited Conduct
You must not use the Platform to exploit price delays or errors, use automated systems we have not approved, coordinate trading with others to abuse our pricing, or engage in any form of market abuse or fraud. If we reasonably believe you have done so, we may cancel the affected trades, withhold related profits, and suspend or close your account.
14. Suspension and Termination
You may close your account at any time by contacting us at support@fusion-fx.net, after closing your open positions. We may suspend or close your account on [NOTICE PERIOD] notice, or immediately if you breach these Terms, if required by law or a regulator, or if we suspect fraud or money laundering. On closure we will close any open positions at current prices, deduct any amounts you owe us, and return the remaining balance to you, subject to our verification checks.
15. Liability
You are responsible for your trading decisions and their results. To the extent permitted by law, we are not liable for losses arising from market movements, from your reliance on information on the Platform, from failures of your device, browser or internet connection, from third-party data or service failures, or from events outside our reasonable control. We are not liable for indirect or consequential loss or loss of profit.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud or for our gross negligence or wilful misconduct.
16. Complaints
If you are unhappy with our service, please email support@fusion-fx.net with your account number and a description of the issue. We will acknowledge your complaint within [ACKNOWLEDGEMENT PERIOD] and aim to give you a final response within [RESPONSE PERIOD]. If you are not satisfied with our final response, you may be able to refer your complaint to [COMPLAINTS / ADR BODY].
17. Changes to These Terms
We may change these Terms. We will give you at least [NOTICE PERIOD] notice of material changes by email or on the Platform, unless the change is required sooner by law. If you do not accept a change, you may close your account before it takes effect.
18. Governing Law and Jurisdiction
These Terms are governed by [GOVERNING LAW / JURISDICTION]. This does not deprive you of any protection given to you by the mandatory laws of the country where you live.
